Waste Clearance Mayfair Service Terms and Conditions

These Terms and Conditions set out the basis on which Waste Clearance Mayfair provides waste clearance and related services to customers. By booking a service, you agree to be bound by these Terms and Conditions. Please read them carefully before placing an order for waste collection or clearance.

1. Definitions and Interpretation

In these Terms and Conditions, the following expressions have the meanings set out below:

Customer means the individual, business, company or organisation that requests and pays for the services.

Services means any waste clearance, rubbish removal, bulky item collection, recycling, loading, transportation, or disposal service provided by Waste Clearance Mayfair.

Waste means items, materials, rubbish, junk, refuse or similar that the Customer asks Waste Clearance Mayfair to remove, except for any prohibited materials defined in these Terms and Conditions.

Booking means a confirmed request for Services made by the Customer and accepted by Waste Clearance Mayfair in accordance with these Terms and Conditions.

Site means the property, premises or location where the Services are to be carried out.

2. Scope of Services

Waste Clearance Mayfair provides waste clearance and rubbish collection services to domestic and commercial customers within its operational service area. The specific scope of each Service, including the type and estimated volume of Waste to be removed, will be agreed at the time of Booking or during an on-site assessment.

Unless expressly agreed in writing, the Services are limited to the loading, removal, transportation and lawful disposal or transfer of Waste. We do not provide building work, demolition, heavy dismantling or specialist cleaning services.

3. Booking Process

3.1 Bookings may be made by telephone, email or through any other contact method we make available. When you make a Booking, you must provide accurate information about the type, volume and location of the Waste, as well as safe access to the Site.

3.2 All Bookings are subject to acceptance by Waste Clearance Mayfair. We may refuse a Booking at our discretion, including where the Waste is unsuitable, access is unsafe, or we do not have availability.

3.3 Any collection time or date provided is an estimate only. We will make reasonable efforts to attend within the agreed time window but cannot guarantee exact times due to traffic, weather, access issues or other factors beyond our control.

3.4 When we arrive at the Site, our operative may reassess the Waste and confirm the final price before commencing the Service. If the volume, weight or nature of the Waste differs from that originally described, we may adjust the price accordingly or decline to proceed.

4. Quotations and Pricing

4.1 Any quote given before inspection of the Waste is an estimate only and is subject to change following on-site assessment.

4.2 Prices are typically based on one or more of the following: the volume of Waste, type of materials, weight, labour required, access to the Site and any additional services requested.

4.3 All prices will be communicated to you before work commences. By allowing us to start the Service, you agree to pay the price quoted at the Site, which supersedes any previous estimate.

4.4 Prices are inclusive or exclusive of VAT depending on our prevailing VAT status. Where applicable, VAT will be added at the prevailing rate.

5. Payments and Invoicing

5.1 Payment is due in full at the time the Service is completed, unless we agree alternative payment terms in writing in advance.

5.2 We may accept payment by cash, card or bank transfer, subject to the options we make available from time to time. Details of accepted payment methods will be provided at the time of Booking or on completion.

5.3 For business customers, we may issue an invoice with specified payment terms. If payment is not received by the due date, we reserve the right to charge interest, administration fees or suspend further Services until all outstanding sums are cleared.

5.4 If a payment is recalled, reversed, cancelled or fails for any reason after we have provided the Service, you remain fully liable for the charges and any associated costs of collection.

6. Cancellations, Changes and No-Show

6.1 You may cancel or reschedule a Booking by contacting us as soon as possible. Where you give at least 24 hours notice before the agreed arrival window, no cancellation fee will normally be charged.

6.2 If you cancel within 24 hours of the agreed arrival window, or if our team attends the Site and is unable to carry out the Service for reasons beyond our control, we may charge a reasonable call-out or cancellation fee to cover our costs.

6.3 If, on arrival at the Site, we consider that the Waste includes prohibited items, or that the Site is unsafe or inaccessible, we may decline to carry out the Service in whole or in part. In such circumstances, a call-out fee may still be payable.

6.4 We reserve the right to cancel or reschedule a Booking for operational or safety reasons, including vehicle breakdown, staff sickness, severe weather or other circumstances beyond our reasonable control. In such cases, we will seek to offer a new appointment, but we will not be liable for any losses or costs you may incur as a result.

7. Access to the Site and Customer Obligations

7.1 You must ensure that we have safe, reasonable and lawful access to the Site during the agreed time window. This includes arranging any necessary permissions, parking, loading bay access, gate codes or authorisations.

7.2 You are responsible for ensuring that the Waste to be collected is clearly identified, safely accessible and not mixed with items you wish to keep. Our operatives will exercise reasonable care, but we are not responsible for removing items that were not clearly separated or indicated as Waste.

7.3 Where we are required to enter a property, you must ensure that the internal route is safe, free from hazards and adequately lit. If our team considers the conditions unsafe, we may refuse to proceed.

7.4 You must not request or permit our operatives to undertake any task that falls outside the agreed scope of the Service or that would breach health and safety rules, waste regulations or these Terms and Conditions.

8. Waste Types, Exclusions and Regulations

8.1 Waste Clearance Mayfair operates in accordance with applicable UK waste management laws and regulations. We will transport and dispose of Waste only via authorised facilities and in compliance with our duty of care obligations.

8.2 The following items are normally considered prohibited or restricted and will not be collected unless previously agreed and subject to specific arrangements: hazardous or toxic substances, chemicals, asbestos, clinical or medical waste, biological waste, gas bottles, pressurised containers, certain electrical items requiring specialist processing, and any other material classified as hazardous waste under applicable law.

8.3 If you include prohibited or restricted materials without notifying us in advance, we may refuse to remove them or may apply additional charges for handling, segregation and lawful transfer.

8.4 You confirm that, to the best of your knowledge, the Waste presented for collection does not contain any dangerous or illegal items and that you have the legal right to dispose of it. You will indemnify us against any claims, losses or penalties arising from a breach of this warranty.

8.5 Where required, we will produce appropriate documentation or waste transfer notes in line with UK regulations. You agree to provide us with any information reasonably required for the preparation of such documents.

9. Ownership of Waste

9.1 Ownership of the Waste transfers to Waste Clearance Mayfair once it has been loaded onto our vehicle and the related payment obligation has arisen.

9.2 Once removed, we may sort, recycle, re-use, recover energy from or otherwise process the Waste in line with our environmental obligations and business practices.

10. Liability and Limitations

10.1 We will exercise reasonable care and skill when providing the Services. However, you acknowledge that waste clearance involves the movement of bulky or heavy items and that some risk of minor damage may exist, particularly in confined spaces.

10.2 We will not be liable for any damage to property or belongings arising from pre-existing defects, structural weakness, poor installation, inadequate access or where items are moved at your specific direction and against our advice.

10.3 Our total liability for loss or damage arising out of or in connection with the Services, whether in contract, tort or otherwise, shall be limited to the amount paid or payable by you for the specific Service giving rise to the claim, except where such limitation is not permitted by law.

10.4 Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, fraud, fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited.

10.5 We will not be liable for any indirect or consequential loss, including loss of profits, business interruption, loss of data, loss of opportunity or any similar damages suffered by you or any third party.

11. Customer Property and Valuables

11.1 You are responsible for removing or clearly separating any items you do not wish to be taken away before our operatives begin work. We accept no responsibility for items removed as Waste if they were not clearly identified as items to be retained.

11.2 We recommend that you remove cash, jewellery, important documents, electronic devices and any other valuables from the area where we will be working. We will not be liable for loss of such items unless directly caused by our deliberate misconduct.

12. Complaints and Disputes

12.1 If you are dissatisfied with any aspect of the Service, you should notify us as soon as reasonably practicable, providing details and any supporting information.

12.2 We will investigate complaints in good faith and attempt to resolve them promptly. You agree to give us a reasonable opportunity to address any concerns, which may include returning to the Site to inspect the issue.

12.3 If a dispute cannot be resolved informally, both parties agree to consider negotiation or other dispute resolution methods before commencing legal proceedings, where appropriate.

13. Events Beyond Our Control

13.1 We will not be in breach of these Terms and Conditions or liable for delay in performing, or failure to perform, any of our obligations if such delay or failure results from events, circumstances or causes beyond our reasonable control. These may include accidents, traffic delays, severe weather, fires, floods, strikes, government restrictions or breakdown of equipment.

13.2 Where an event beyond our control affects our ability to perform the Services, we will contact you as soon as reasonably possible to arrange a suitable alternative date or time.

14. Data Protection and Privacy

14.1 We may collect and process personal data about you, such as your name, contact details and service address, to manage Bookings, provide Services, carry out invoicing and handle queries or complaints.

14.2 We will handle personal data in accordance with applicable data protection laws and use it only for legitimate business purposes connected with the provision of our Services, record-keeping and compliance obligations.

15. Amendments to These Terms

15.1 We may update or revise these Terms and Conditions from time to time. The version in force at the time you make a Booking will apply to that Booking.

15.2 Any changes will be effective from the date they are published or otherwise communicated to you. Continued use of our Services after such changes will constitute your acceptance of the updated Terms and Conditions.

16. Severability

16.1 If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, illegal or unenforceable, that provision shall be deemed deleted, but the remaining provisions shall continue in full force and effect.

17. Entire Agreement

17.1 These Terms and Conditions, together with any written confirmation of your Booking and any agreed variations, constitute the entire agreement between you and Waste Clearance Mayfair in relation to the Services. You acknowledge that you have not relied on any statement, promise or representation that is not set out in these documents.

18. Governing Law and Jurisdiction

18.1 These Terms and Conditions and any dispute or claim arising out of or in connection with them, or with the Services, shall be governed by and construed in accordance with the laws of England and Wales.

18.2 You and Waste Clearance Mayfair agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the provision of the Services.

By confirming a Booking with Waste Clearance Mayfair or allowing our operatives to commence work, you acknowledge that you have read, understood and agree to be bound by these Terms and Conditions.
